JULY 6, 1999 FIRST MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, July 6, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish, and Welte. Staff members present were Karen James, Executive Secretary/Public Bidder and Patrick F. Gill, County Auditor/Clerk to the Board.

The Claims were approved as presented.

Meeting called to order.

There was open discussion period held by the Board.

Motion by Boykin second by Walish to approve the Board minutes of June 29, 1999 as submitted. Carried 5-0.

Motion by Welte second by Batcheller to approve the minutes of the Executive Session of June 29, 1999 as submitted. Carried 5-0.

The Board approved the reclassification of Stacy L. Dillard-Spahn, Assistant County Attorney, County Attorney, @$35,700/yr., effective date 7/8/99. Per AFSCME Assistant Attorney Contract agreement, from Step 1 to Step 2. Copy filed.

Motion by Boykin second by Batcheller to authorize Chairman to sign Authorization to Initiate Hiring Process for F/T Youth Worker, Juvenile Detention, AFSCME J.D./Current Wage. Carried 5-0. Copy filed.

The Public Hearing and sale of Real Estate Parcel #474630 was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Boykin second by Welte to close the Public Hearing on the sale of Real Estate Parcel #474630as there was no one present wishing to be heard on said sale. Carried 5-0.

Chairman called for bids on Real Estate Parcel #474630. Kelly Peterson bid $1,500 plus recording fees. There were no further bids.

Motion by Batcheller second by Welte to accept Kelly Petersons bid of $1,500 for Real Estate Parcel #474630 plus recording fees. Carried 5-0.

RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA #9206

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: KELLY S. AND BEVERLY ANN PETERSON, HUSBAND AND WIFE, AS JOINT TENANTS WITH FULL RIGHTS OF SURVIVORSHIP AND NOT AS TENANTS IN COMMON

in the sum of ONE THOUSAND FIVE HUNDRED AND NO/100 ($1,500.00) Dollars for the following described real estate to wit:

Lot Four (4) Block Six (6) So. Smith Villa Addition, City of Sioux City, Woodbury County, Iowa



now and included in and forming a part of the City of Sioux City, Iowa, the same is hereby accepted; said amount being a sum LESS than the amount of the general taxes, interests, costs and penalties against the said real estate.

BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded.

BE IT RESOLVED that per code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s).

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

There was discussion about letter of understanding with Williams & Company to perform audit services for Woodbury County.

Motion by Batcheller second by Welte to approve and authorize Chairman to sign letter of understanding with Williams & Company to perform audit services for Woodbury County. Carried
5-0.

Motion By Walish second by Batcheller to authorize the chairman to sign a letter of notification to Dierking, Lockie & Associates. Carried 5-0.

There was a discussion of a letter of support for a grant application for Siouxland Regional Recycling Center for a toxic clean up day, Fall 2000.

Motion by Welte second by Walish to approve the appointment of Phil Kratz to the Woodbury County Community Action Agency board in the public official group and as a Welfare Representative. Carried 5-0.

Motion by Boykin second by Welte to approve the transfer of a $60,000 appropriation from Building Services-Courthouse to Building Services Law Enforcement Ctr. in the County budget for FY 1999 and the transfer of a $6,000 and $4,000 appropriation from Building Services - Trosper Hoyt to Building Services Law Enforcement Ctr. in the County budget for FY 1999. Carried 5-0

Motion by Boykin second by Walish to authorize the Chairman to sign Emergency Medical Services Training Money Contract. Carried 5-0. Copy filed.

Motion by Boykin second by Batcheller to approve and authorize Chairman to sign Single County Contract with State of Iowa. Carried 5-0. Copy filed.

Motion by Boykin second by Walish to approve and authorize Chairman to sign Single Contract Addendum Application for State FY2000 Board of Health Infrastructure Appropriations. Carried 5-0.

Philip Kratz, Anita Beckish, and Christine Huisman from Department of Human Services discussed the 28E Agreement between Iowa Department of Human Services, Woodbury County and Woodbury County Auditor.

Motion by Boykin second by Walish to approve and authorize Chairman to sign 28E Agreement for Pre FIP Diversion Agreements. Carried 5-0. Copy filed.

Motion by Welte second by Batcheller to approve and authorize Chairman to sign 28E Agreement for Post FIP Diversion Agreements. Carried 5-0. Copy filed.

There was discussion of moving costs and additional furniture needs.

Motion by Boykin second by Welte to approve for the Department of Human Services move, the additional cost of $2,113.60 for furniture overlooked in the original bids for office equipment and up to $530 for boxes. Carried 5-0.

Auditors Mapping Department, Dean Neal updated the Board on GIS Mapping Project.

Building Services, Mark Elgert discussed a truck bid for Building Services Department.

Motion by Welte second by Boykin to approve the bid for a truck for Building Services from Charlie Zook Motors for $26,000. Carried 5-0.

Motion by Welte second by Boykin to refer Long Lines, Ltd. request to Zoning Commission for recommendations. Carried 5-0.

Motion by Boykin second by Welte to go into Executive Session per Iowa Code Section 21.5(1)(J) Real Estate Purchases. Carried 5-0 on a roll call vote.

Motion by Boykin second by Batcheller to go out of Executive Session. Carried 5-0 on a roll call vote.

Motion by Welte second by Boykin to approve three appraised offers for properties in Holly Springs submitted by the planning and zoning department. Carried 5-0.

Dan Moore, attorney representing Gary and Shirlee Stevenson 2427 Mohawk Dr. and Mr. Stevenson addressed the Board about the repair of a retaining wall. Frank Gray 2425 Mohawk Dr., an affected property owner also addressed the Board.

The Board canvassed the June 29,1999 Special Election for the Constitutional Amendments with the following official results:

Vicki Ritz, Deputy Commissioner of Elections, announced that there were 14 challenged ballots of which 1 was accepted and added to the Tally. There were also 15 after election absentee ballots which were postmarked prior to Election Day, were received timely and added to the Tally.

Upon the Question Number 1.

Shall the following amendment to the constitution be adopted? Requires the Governor and Legislature to prepare and approve budgets for general fund expenditures which are no more than 99% of estimated revenues and carryover funds. Only 95% of new revenues may be included in general fund expenditures.

There were Eleven Thousand Two Hundred Seventy-Six, (11,276) votes cast, as follows:

For the question, Five Thousand Eight Hundred Thirty-Nine (5,839) votes. Against the question, Five Thousand Four Hundred Thirty-Seven (5,437) votes

Upon the Question Number 2.

Shall the following amendment to the constitution be adopted? Requires approval of three-fifth (60%) of all members of both the Iowa House and Senate to increase state revenues through state corporate and personal income tax or state sales and use taxes or to establish a new state tax.

There were Eleven Thousand Two Hundred Forty-One (11,241) votes cast as follows:

For the question, Five Thousand Seven Hundred Thirty-Four (5,734) votes. Against the question, Five Thousand Five Hundred Seven (5,507) votes.

There were Eleven Thousand Three Hundred Fifty-Seven (11,357) people that voted in Woodbury County at the Special Election held on June 29, 1999.

Motion By Welte second by Batcheller to approve and receive for signatures the Canvass of the Special Election. Carried 5-0.

The Board adjourned the regular meeting until July 13, 1999.
