JANUARY 5, 1999 - TWENTY-FIFTH MEETING OF THE BOARD OF SUPERVISORS
The Board of Supervisors met on Tuesday, January 5, 1999 at 9:00 A.M. Board members present were Batcheller, Boykin, Clausen, Walish and Welte. Staff members present were Nancy Hodge, Board Administrative Coordinator, Ann Long, Assistant County Attorney and Patrick F. Gill, County Auditor/Board Secretary.

The Claims were approved as presented.

Meeting called to order.

Mr. Batcheller nominated Larry Clausen as Chairman of the Board of Supervisors for the year 1999. Mr. Clausen was elected on a 4-0 vote with Clausen abstaining.

Motion by Boykin second by Batcheller to approve the regular Board minutes of December 22, 1998 as submitted. Carried 5-0.

There was open discussion period held by the Board.

Motion by Boykin second by Batcheller to approve the appointment of Richard Storm to the position of County Engineer. Carried 5-0.

Motion by Welte second by Boykin to approve the appointment of Kerby Weber to the position of County Weed Commissioner. Carried 5-0.

Motion by Batcheller second by Batcheller to approve the appointment of Dr. Thomas Carroll to the position of County Medical Examiner. Carried 5-0.

Motion by Welte second by Boykin to approve the appointment of Larry Clausent as the County Representative to serve on the Board of Directors of the Third Judicial District Department of Correctional Services. Carried 5-0.

Motion by Batcheller second by Boykin to approve the appointment of Moville Record, Anthon Herald and the Sioux City Journal as the County Newspapers for legal publication. Batcheller asked for and received unanimous consent to withdraw his motion. Consensus was to postpone action on the designation of the county newspaper for legal publication until the next meeting in order to obtain more information.

The Public Hearing and sale of property to Jack Cook Farms, Inc. was held at 10:15 A.M. The Chairman called on anyone wishing to be heard on said sale.

Motion by Welte second by Boykin to close the Public Hearing on the sale of property to Jack Cook Farms, Inc. only. Carried 5-0.

Motion by Welte second by Boykin to authorize the Chairman to sign a Quit Claim Deed conveying property to Jack Cook Farms. Inc. Carried 5-0.

Motion by Boykin second by Batcheller to sell property to Jack Cook Farms, Inc. for $1.00 plus publication fees, service cost and recording fees. Carried 5-0.




RESOLUTION OF THE BOARD OF SUPERVISORS OF WOODBURY COUNTY, IOWA: #9141

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer of: JACK COOK FARMS, INC.

in the sum of ONE AND NO/100 ($1.00) Dollars PLUS PUBLICATION COSTS & RECORDING FEES for the following described real estate to wit:

A tract of land located in the SW 1/4 SE 1/4 of section 32, T88N, R47W of the 5th P.M., Woodbury County, Iowa further described as follows: Commencing at the SW corner of the SE 1/4 of said section 32; thence east along the south line of the SE 1/4 33.0 feet to the point of beginning, thence north parallel to and 33.00 feet normally east of the west line of the SE 1/4 of said section 32 for a distance of 735.00 feet; thence east 22.00 feet, thence south 735.00 feet to the south line of the SE 1/4, thence west 22.00 feet to the point of beginning. Containing 0.35 acres, more or less.

Note: The west line of the SE 1/4 of said section 32 is assumed to bear north.

such proceedings filed on January 24, 1989 and May 12, 1989 on Roll 211 at Image 799 and on Roll 215 at Image 577, respectively, of the records of the County Recorder of Woodbury County, Iowa; and

BE IT RESOLVED that certain proceedings in the matter of the condemnation from Jack Cook Farms, Inc., has been withdrawn and this sale has been requested to clear any questions about the title to such property.

BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quitclaim Deed for the said premises to the said purchaser.

Motion by Welte second by Boykin to authorize the Chairman to sign the proposal of Compass Environmental Services of Ankeny, IA for a Tier 2 RBCA Report for the underground storage tank at the Woodbury County Maintenance Facility in Hornick. Carried 5-0.

Motion by Boykin second by Welte to authorize the Chairman to sign four project agreements for funding of Stream Stabilization Project by Hungry Canyons Alliance. Carried 5-0.

Motion by Boykin second by Welte to approve and receive for signatures a resolution authorizing the County Engineer to execute certification of completion and final acceptance for all Farm-to-Market Construction Projects in the county. Carried 5-0.

BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa that Richard J. Storm, the County Engineer of Woodbury County, Iowa, be and is hereby designated, authorized, and empowered on behalf of the Board of Supervisors of said County to execute the certification of completion of work and final acceptance thereof in accordance with plans and specifications therefore in connection with all Farm to Market construction projects in this county.

Motion by Batcheller second by Boykin to approve the appointments to the Commission to Assess Damages Category A Owner/operators of Agricultural Property: LeRoy Hoelker, Donald Johnson, Elleen Oberreuton, Wallace Sorenson, and Noel Plummer. Carried 5-0.

Motion by Welte second by Walish to approve the appointments to the Commission to Assess Damages Category B Owners of City Property: Robert Booth, Rodney Hunter, Peter Macfarlane, Wayne B. Ducommun, George Finzen, and Ruth A. Groth. Carried 5-0.

Motion by Boykin second by Welte to approve the appointments to the Commissions to Assess Damages Category C Licensed Real Estate Salesman or Real Estate Broker: Colleen R. Baker, Terry Kroeger, Cleo Pottorff, Beverly Hinds, and Carolyn Oleson. Carried 5-0.

Motion by Walish second by Batcheller to approve the appointments to the Commissions to Assess Damages Category D Persons Having Knowledge of Property Values in the County by Reason of their Occupation: Rick Aadland, Patrick Curry, Robert Huisenga, Kathie Von Aswege, and Jon Wilcke. Carried 5-0.

There was a discussion of Stop-loss liability insurance proposals and recommendations. Consensus was to ask the vendors to keep their proposals open through the budget process.

There was a discussion of what property at the County Farm to sell.

Motion by Welte second by Batcheller to allow the Chairman to arrange the survey, auction and sell the tillable. Carried 5-0.

Motion by Welte second by Batcheller to set the mileage reimbursement rate for County employees to follow the federal rate. Carried 5-0.
