FEBRUARY 28, 2012 — NINTH MEETING OF THE WOODBURY COUNTY BOARD OF SUPERVISORS The Board of Supervisors met on Tuesday, February 28, 2012 at 10:00 a.m. Board members present were Clausen, Monson, Tripp, and Smith; Boykin absent. Staff members present were Karen James, Board Administrative Coordinator, Joshua Widman, Assistant County Attorney, and Jean Jessen, Deputy Auditor. The Claims were approved as presented. Copy filed. The meeting was called to order. Motion by Tripp second by Monson to approve the minutes of the 02/21/2012 Board meeting. Carried 4-0. Copy filed. The Board approved the reclassification of Dustin DeGroot, Civilian Jailer, County Sheriff Dept., effective 03-15-12, $19.58/hour, 10.8%=$1.92/hr. Per CWA Civilian Officer Contract Agreement, from Class 1 to Senior Class due to 6 years employment and 2 year Associate Degree. Copy filed. WOODBURY COUNTY, IOWA WHEREAS, Susan Motley is the titleholder of property located at 1421 Ruby Street, Sioux City, Woodbury County, Iowa, and legally described as follows: Lot Seven (7) Block Eleven (11) Coe 2nd Addition, City of Sioux City, Woodbury County, Iowa WHEREAS, Susan Motley is the titleholder of the aforementioned property have petitioned the Board of Supervisors for a suspension of taxes pursuant to the 2009 Iowa Code section 427.9, and WHEREAS, the Board of Supervisors recognizes from documents provided that the petitioner is unable to provide to the public revenue; and NOW, THEREFORE, BE IT RESOLVED, that the Woodbury County Board of Supervisors hereby grants the request for a suspension of taxes, and hereby directs the Woodbury County Treasurer to so record the approval of this tax suspension for this property. SO RESOLVED this 28th day of February, 2012. Motion by Clausen second by Monson to approve the payment of $1,308.25, which is 25% of the project costs, to Sidwell Company Survey to perform a work flow analysis survey of the GIS maintenance workflow. This would be funded using Riverboat Funds. Carried 4-0. Presentation of Little Sioux Watershed Works by Jerry Sindt & Ken Gard. A public hearing was held at 10:15 a.m. for the sale of property parcel #058455 (1409 Myrtle St.). The Chairman called on anyone wishing to be heard. BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that the offer at public auction of: By Lea and Charles Knowles______in the sum of Two Hundred Dollars & 00/100 ($200.00)-----------------------------------------------------dollars. For the following described real estate, To Wit: Parcel #: 058455 BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded. BE IT RESOLVED that per Code of Iowa Section 569.8(3 & 4), a parcel the County holds by tax deed shall not be assessed or taxed until transferred and upon transfer of a parcel so acquired gives the purchaser free title as to previously levied or set taxes. Therefore, the County Treasurer is requested to abate any taxes previously levied or set on this parcel(s). BE IT FURTHER RESOLVED that the Chairman of this Board be and he is hereby authorized to execute a Quit Claim Deed for the said premises to the said purchaser. SO DATED this 28th Day of February, 2012. A public hearing was held at 10:17 a.m. for the sale of property parcel #008835 (210 W. 2dn St, Sioux City). For the following described real estate, To Wit: Parcel #: 008835 BE IT RESOLVED that payment is due by close of business on the day of passage of this resolution or this sale is null and void and this resolution shall be rescinded. Motion Tripp by second by Monson to approve and authorize the Chairman to sign a Resolution for the sale of Right of Way in Luton to Sandra Kay Lau for $1.00 plus recording fees. Carried 4-0. WHEREAS the Woodbury County Board of Supervisors has set forth its proposal to sell its interest, if any, in the herein described real property in a resolution; and WHEREAS a public hearing was held on said proposal on February 28, 2012, pursuant to published notice as provided by law; and WHEREAS the Board of Supervisors has heard all the comments for or against said proposal and believes quitclaiming its interest, if any, in the real property is in the public interest; and WHEREAS Woodbury County is simply relinquishing its interest in the property, if any, and is not providing any guaranty or warranty of title; NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Woodbury County, Iowa, that Woodbury County’s interest, if any, in the following described real estate shall be quitclaimed to Sandra Kay Lau in exchange for the sum of One dollar ($1.00) plus recording fees. Said real estate legally described as follows, to Wit: All of vacated Second Street adjacent to Lot One (1) in Block Eight (8) extended South to the South line of the North One-half (N ½ ) vacated East-West alley extended East, and all of vacated Third Street adjacent to Lot Six (6) in Block Eight (8) extended South to the South line of the North One-half (N ½ ) vacated East-West alley extended West, and all of the North One-half (N ½ ) vacated East-West alley in Block Eight (8), all in the Town of Luton, in the County of Woodbury and State of Iowa. BE IT RESOLVED that payment is due within thirty (30) days of the passage of this resolution. SO DATED this 28th day of February, 2012. Motion by Monson second by Tripp to approve and authorize the Chairman to sign a Quit Claim Deed to Sandra Motion by Monson second by Clausen to approve the Consultant Agreement for 2012 Bridge Inspection and Rating Program with Calhoun-Burns and Associates, Inc., per recommendation of Mark Nahra, County Engineer. Carried 4-0. Copy filed. Motion by Monson second by Tripp to approve and authorize the Chairman to sign a resolution for Bridge Posting. Carried 4-0. RESOLUTION OF THE BOARD OF SUPERVISORS WHEREAS: The Board of Supervisors is empowered under authority of Sections 321.236 Sub. (8), 321.471 to 321.473 to prohibit the operation of vehicles or impose limitations as to the weight thereof on designated highways or highway structures under their jurisdiction, and WHEREAS: the Woodbury County Engineer has caused to be completed the Structure Inventory and Appraisal of certain bridges according to accepted Bridge Inspection Standards and has determined that the bridges below, require revision to their current load ratings, NOW, THEREFORE, BE IT RESOLVED by the Woodbury County Board of Supervisors that the following vehicle and load limit be established and that signs be placed advising of the permissible maximum weights thereof on the bridge listed herein.
